Terms of service

These terms govern your use of AcePatent, operated by [COUNSEL: legal entity name, address, jurisdiction].

1. What AcePatent is, and is not

  • AcePatent is software that helps you prepare a patent application. It is not a law firm and does not provide legal advice. No attorney-client or agent-client relationship is created by using it.
  • If you file an application prepared with AcePatent yourself, you file it on your own behalf (pro se) and are responsible for its content and for meeting every deadline.
  • A company, university or other organisation filing as applicant must be represented by a registered patent practitioner before the USPTO (37 CFR 1.31), and in Canada generally by a registered patent agent.

2. AI-generated content

  • Drafts, searches and reviews are produced by an AI system and can be wrong or incomplete. You must read and verify everything before signing or filing it (37 CFR 11.18).
  • A prior-art search by AcePatent is not a guarantee that no closer prior art exists.
  • Only natural persons who contributed to the conception of a claimed invention may be named as inventors. AI tools are never inventors.

3. Accounts

  • Individual accounts are for one person. Organisation accounts are administered by the organisation, which decides who has access and is responsible for its users.
  • Keep your password confidential. Tell us immediately about any unauthorised use.

4. Payment

  • Innovation seats and credits unlock one invention from the prior-art search to the filing package, including revisions within reasonable use.
  • Organisation seats are billed monthly in advance; changes are prorated. You can cancel at any time, effective at the end of the billing period.
  • Government fees (USPTO, CIPO, WIPO) are paid by you directly to the office and are not included.

5. Your content and confidentiality

  • You keep all rights in your invention disclosures, drafts and files. We use them only to provide the service to you.
  • We do not use your content to train AI models, and our AI provider does not either. See the privacy policy.
  • You can delete an application at any time; deletion is permanent.

6. Practitioner services

Where you engage a registered practitioner through AcePatent, the practitioner, not AcePatent, provides the legal services, under their own engagement terms. [COUNSEL: fee arrangement compliant with ABA Model Rule 5.4 and 37 CFR 11.504.]

7. Liability
